Rape victim wins legal challenge

A member of the stolen generation who was allegedly raped an estimated 500 times while in foster care has succesfully challenged a ruling that she be compensated for only one of the assaults. The NSW Supreme Court yesterday quashed a Victims Compensation Tribunal finding that the woman — who had claimed compensation for seven of the alleged abuses — was entitled to only one claim because the rapes were related. Judge Stephen Rothman yesterday labelled the tribunal’s findings “irrational”. Sexual assault advocates said the ruling would set a precedent for other victims. The victim alleges she was raped frequently by a relative of her foster parents.
